TENANCY AGREEMENTS

SC Properties will prepare a tenancy agreement using a standard form based upon the 1988 Housing Act which will revert to a Statutory Periodic Tenancy at the end of the fixed term tenancy unless otherwise agreed.

 

INVENTORY

It is essential to have a detailed inventory incorporated into any tenancy agreement. We will arrange to compile a full inventory for the property along with suporting photos, it is important the landlord satisfies themselves as to the accuracy of any inventory as SC Properties cannot accept any liability for any claims which may arise.

 

RENTAL

Rents collected will usually be inclusive of all outgoings for which the landlord is responsible  (insurance premiums and any ground rents payable). Monthly rent statements can be emailed over or posted.

 

TAXES MANAGEMENT ACT 1978

Under Section 78 of the above act, SC Properties, as your agents, will be obliged to pay any tax liability which arises on rent collected by us during the period the landlord resides abroad. If you are resident abroad it will be necessary for us to deduct tax at the basic rate, unless you have agreed otherwise with you Inspector of taxes and the Inspector has so certified to us, your agent.

 

 

SUB LETTING

It is essential if you are a tenant or lessee that you obtain permission from your landlord, if this is required according to the terms of your lease, prior to any tenant being found for you. The furnished tenancy must expire prior to the termination of your lease.

 

 

MORTGAGES

Permission is normally required by the mortgagee to let the property and it is advisable to obtain this permission, in principle, prior to a tenant being found. Mortgage companies usually charge a small fee for issuing a letter of authority to let your property.

 

EMPTY PROPERTIES

Unless specific written agreements have been made to do so we do not undertake management of unoccupied property before the commencement or after the expiration of a tenancy, nor during any period between tenancies.

 

 

LANDLORD'S RESPONSIBILITY

It is a landlord's duty to advise SC Properties of all relevant information concerning the property, including any restrictions or obligations affecting the use of the property.

The landlord agrees that he will promptly pay any ground rent, service charges, insurance premiums and mortgage payments concerning the property.

 

POST

It is advised that a Royal Mail forwarding postal service is used as  any mail you may receive at the property cannot be guaranteed to be forwarded on by the tenant.


 

PRIOR TO LETTING

 

The landlord must ensure that the property is cleaned throughout. All machines, appliances and heating / water systems should be in excellent working order and clear instructions for use must be left. Carpets and curtains should be professionally cleaned where possible. Windows should also be cleaned and gardens well maintained.

 

 

FEES

 

Our services will be tailored to suit your individual requirements and our agreed fees will be displayed on the attached paperwork. However, the following apply in all cases.

 

At the commencement of each tenancy, SC Properties are entitled to the agreed fees in full for the term of that tenancy. Fees for extended tenancies are payable from the time of renewal. In the event that a landlord arranges to terminate a tenancy before its due date, SC Properties are entitled to fees for the full term of the tenancy as written on the agreement. One full months notice is required once out of a fixed term agreement to terminate our management services.
